The purpose of these Conditions of Use is to set out the terms on which Mavic allows users to access and use the Mavic sites. Use of the Mavic sites is subject to full acceptance and observation of the following Conditions of Use, as well as all applicable laws. In the event where you the user are not in complete agreement with the conditions of use laid down below, you are strongly advised not to use the Mavic sites. 2. Ownership of rights: intellectual property

2.1. Copyright and/or rights in designs and models

These sites constitute a work of which Mavic is the author within the meaning of articles L.111.1 et seq of the French Intellectual Property Code. The entirety of the content of the Mavic sites, including photographs, text, slogans, drawings, images and animations with or without sound, as well as all works forming any part of the
sites, are the property of Mavic or of third parties which have authorised Mavic to use them. These elements are protected by national and international intellectual property law (copyright © 2017, Mavic SAS).
The products represented on the sites are protected by copyright, under articles L.511.1 et seq of the French Intellectual Property Code relating to the protection of registered designs. Therefore, save with the prior written authorisation of Mavic SAS and/or its partner organisations, users may not carry out, by any means and/or using any hardware or media whatsoever, any reproduction, download, representation, adaptation, translation and/or
transformation, or any transfer to another website, of the whole or any part of any element of this site. Subject to the exceptions provided for below, failure to observe this prohibition constitutes an offence of counterfeiting which is punishable by four years of imprisonment and a fine of €400,000. Making paper or digital copies of the said sites, or of the products there shown, is permitted provided that it is strictly limited to personal use, excluding any usage for advertising and/or commercial and/or information purposes, and/or that it conforms to article L122-5 of the French Intellectual Property Code.

The Mavic name and logo as well as the names of certain products are registered trademarks of Mavic SAS. All rights reserved. Other trademarks may also be mentioned. These are used by Mavic either with the permission of their owner or simply to identify products offered by Mavic. Reproducing, imitating, using or affixing these trademarks, without having obtained prior authorisation from Mavic, constitutes an offence of counterfeiting punishable by four years imprisonment and a fine of €400,000. 

3. Hypertext links

3.1. Hypertext links to Mavic sites

The provision of a hypertext link to the Mavic sites requires prior written authorisation from Mavic. A user wishing to provide a hypertext link to the Mavic sites must contact the manager
of the Mavic sites. The provision of a hypertext link in no way authorises the reproduction of any element of the Mavic sites or the presentation on third-party sites of such elements whether in the form of frames or by any similar means. Mavic will not be held responsible in any circumstances for content, products or services offered by third-party sites which contain a hypertext link to the Mavic sites.

3.2. Hypertext links to other internet sites

Hypertext links on the Mavic sites may link to other websites or other internet resources. Mavic wishes to emphasise that these General Conditions do not apply to third-party sites. Since Mavic cannot control such external sites or resources, it shall be under no liability in relation to content, advertising material, products, services or any other material which is available on or through such external sites or resources. Further, the user acknowledges that Mavic may not be held responsible for any damage or loss, whether established or alleged, resulting from or relating to either use of or reliance on the content, goods or services available on such external sites or resources. 

4. Data protection

4.1. Privacy policy

Amer Sports is committed to protecting your privacy and complying with applicable data protection and privacy laws. This Privacy Policy (“Policy”) is designed to help you to understand what kind of information we collect in connection with our products and services and how we process and use such information. Throughout this Policy the term “personal data” means information relating to an identified or identifiable individual (i.e. a natural person). 

“Amer Sports” refers to Amer Sports Corporation, including all its group companies, affiliates and subsidiaries from time to time (also referred to as “we”, “us”, or “our”). Brands of Amer Sports are listed in You acknowledge and agree that your personal data collected may be used in accordance with this Policy by and for one or more Amer Sports group companies, which will be regarded, individually or jointly, as data controllers in respect of such data. 

This Policy applies to personal data collected in connection with products and services offered by Amer Sports or from other interactions with us where a link or other appropriate reference of incorporation to this Policy is made, for example, in connection with our products, websites, applications and other types of services offered by Amer Sports typically in electronic form, as well as other services such as customer care and warranty services, customer events, or promotions and campaigns.

We may provide additional privacy related terms in connection with a particular Amer Sports product or service. Such product or service specific terms prevail over this Policy to the extent of any conflict. Our products or services may also contain links to other companies’ websites and other third party services that have privacy policies of their own. We recommend that you carefully read the privacy policies of such services. Amer Sports is not responsible for the privacy practices or contents of any such third party services.

Where a consent from you to the processing of personal data described in this Policy is required under the applicable law, such consent will be obtained by appropriate mechanism such as ticking a box stating your consent, choosing technical settings for a service or website, or other statement or conduct clearly indicating your acceptance to the processing, depending on the product, website, service or application you are using.

4.2. Data collected

We collect your personal data typically when you purchase our products or services, use or register into our services, enter into a sales promotion or a campaign, or otherwise interact with us. Below are examples of the categories of the data we collect on you. 

Technical Information. For the most part, you may visit our websites or use our products or services without having to identify yourself. However, certain technical information is normally collected as a standard part of your use of our services. Such information includes, for example, your IP-address, access times, the website you linked from, pages you visit, the links you use, the ad banners and other content you viewed, information about your devices and other such technical information your browser provides us with or as may be otherwise collected in connection with certain products and services. When you use our services or otherwise interact with us over telecommunications networks, certain additional information, such as your mobile subscription number, may be transmitted to us by the telecommunications operator as a standard part of that communication.  Please also see the section “Use of Cookies and Web Beacons” below.

Information you provide us. When you register to our services, make a purchase, enter a sales promotion or otherwise interact with us, we may ask you to provide us with certain information such as your name, email address, street address, as well as user names, passwords and other such credentials that are used to authenticate users and to validate their actions or that may be needed to provide you with the products and services you have requested or to communicate with you, as well as information uploaded by you such as location, route information, pictures etc. We may collect training data, demographic information, for example, your age, gender, postal code and language preferences.

We may also collect other information you provide, such as your consents, preferences and feedback, information relating to your devices and other such information you provide us with. Please note that certain non-identifiable information collected from you may become personally identifiable when you provide us with your personal data. Some of our services may allow you to submit information about other people, for example, if you make an order for a product that you wish us to send directly to another recipient.

Special categories of personal data. We may collect your biometrical and health related data such as blood pressure, heart rate, fingerprints or similar depending on the service or product you have purchased. Users are requested to grant consent for such data collection explicitly per each service or product in question. For certain services or applications, this may be done by adjusting the settings of the application or service. Denial of the consent may affect the provision of the relevant service.

Your transactions with us. We collect or request information relating to your purchase or use of our products or services as well as your other interactions with us. Such information may include, for example, details of the queries or requests you have made, the products and services provided (including delivery details), purchasing details (including payments made, credit card details, billing address, credit checks and other such financial information), details of agreements between you and Amer Sports, records of contacts and communications, information and details relating to the content you have provided us with and other such transactional information. We may, in accordance with applicable law, record your communication with our customer care or with other similar contact points. 

Location data. Certain services may involve the use of your location data. Use of your location data is, however, subject to your prior consent for each service.

Data obtained from third parties. In addition to the personal data we obtain from you, we may obtain, in accordance with applicable laws, certain personal data from list rental companies and other publicly available sources. This may include personal data such as credit information and address information updates.

4.3. The purposes of processing

Amer Sports processes your personal data for the purposes described in this Policy and/or any additional service specific privacy information. Please note that one or more purposes may apply simultaneously. 

Provision of products and services. We may process and use your personal data to provide you the product or service you have requested, fulfill your other requests, process your order or as otherwise may be necessary to perform or enforce the contract between you and Amer Sports. We may also process and use your personal data to ensure the functionality and security of our products and services, to identify you, and to prevent and detect fraud and other misuses.

Development of products and services. We may process and use your personal data to develop our products and/or services. However, for the most part we only use aggregate and statistical information in the development of our products and services, and not data directly identifiable to you. We may also process and use your personal data to personalize our offerings and to provide you with service more relevant to you, for example, to make recommendations and to display customized content and advertising. We may combine personal data collected in connection with your use of a particular Amer Sports product and/or service with other personal data we may hold about you, except where such personal data was collected for a different purpose. 

Communicating with you and marketing. We may process and use your personal data to communicate with you, for example, to provide information relating to our products and/or services you are using or to contact you for customer satisfaction queries. We may process and use your personal data for marketing. Marketing purposes may include using your personal data for personalized marketing or research purposes in accordance with applicable laws, for example, to conduct market research and to communicate our  products, services or promotions to you via our own or third parties’ electronic or other services. 

In addition, some of our products and services may be used to promote products and services of other companies. However, Amer Sports does not disclose your personal data to such companies for their marketing purposes without your prior consent. 

Profiling. We may process and use your personal data for profiling for such purposes as targeted direct marketing and improvement of our products or services. We may also create aggregate and statistical information based on your personal data. Profiling includes automated processing of your personal data for evaluating, analyzing or predicting your personal preferences or interests in order to, for example, send you marketing messages concerning products or services best suitable for you. 

4.4. Transfers of your personal data

We may disclose your personal data to third parties solely as stated below in this Policy, or as obligated by mandatory law.

Amer Sports group companies. You acknowledge and agree that we may share your personal data within Amer Sports group companies, and may transfer your personal data for the use of other Amer Sports group companies. 

Service providers and other authorized third parties. We may transfer your personal data to authorized third parties who process personal data on behalf of Amer Sports for the purposes described in this Policy, such as e.g., technical, logistics and other service providers  Such parties are not permitted to use your personal data for any other purposes than for what your personal data was collected, and we require them to act consistently with applicable laws and this Policy as well as to use appropriate security measures to protect your personal data. 

We may also transfer your personal data, including heart rate data, biometrical data or other health related data, to a service partner, if you use such services where a third party company needs to process such data for the provision of the respective service or where you separately agree that a third party company may process your data in connection with the services or products of Amer Sports.

International transfers. Our products and services may be provided using resources and servers located in various countries around the world. Therefore your personal data may be transferred outside the country where you use our services, including to countries outside the European Economic Area (EEA), where the level of data protection may not be deemed adequate by the European Commission. In such cases we take steps to ensure that adequate protection for your personal data is provided as required by applicable laws. For international transfers of your personal data, we generally rely on agreements that are based on the Standard Contractual Clauses (“SCCs”) of the European Commission. You may find the SCCs here. Other disclosures. We may disclose and otherwise process your personal data in accordance with applicable laws to defend Amer Sports’ legitimate interests, for example, in civil or criminal legal proceedings.

If we decide to sell, buy, merge or otherwise reorganize our businesses in certain countries, this may involve us disclosing personal data to prospective or actual purchasers and their advisers, or receiving personal data from sellers and their advisers, for the purposes of such transactions.

4.5. Data concerning minors

We take reasonable steps to keep the personal data we possess accurate and up-to-date and to delete out of date or otherwise incorrect or unnecessary personal data.

Certain Amer Sports products and services may allow you to manage your profile and the information in such profile. We encourage you to access your personal data via your profile from time to time to ensure that it is correct and up-to-date. Please remember that for such electronic services where you may manage your profile, it is your responsibility to provide us with correct details as well as to update the personal data you have provided us with in case of any changes.

4.6. Data quality and retention

We take reasonable steps to keep the personal data we possess accurate and up-to-date and to delete out of date or otherwise incorrect or unnecessary personal data.

Certain Amer Sports products and services may allow you to manage your profile and the information in such profile. We encourage you to access your personal data via your profile from time to time to ensure that it is correct and up-to-date. Please remember that for such electronic services where you may manage your profile, it is your responsibility to provide us with correct details as well as to update the personal data you have provided us with in case of any changes.

4.7. Data security

Amer Sports implements appropriate technical and organizational security measures to prevent and minimize risks associated with providing and processing personal data. 

Such security measures include, where appropriate, the use of firewalls, secure server facilities, encryption, implementing proper access rights management systems and processes, careful selection of processors, sufficient training of Amer Sports’ personnel involved in the processing, and other necessary measures to provide appropriate protection for your personal data against unauthorized use or disclosure. Where appropriate, we may also take back-up copies and use other such means to prevent accidental damage or destruction of your personal data. If a particular part of an Amer Sports website supports on-line transactions, we will use an industry standard security measure, such as the one available through “Secure Sockets Layer” (“SSL”), to protect the confidentiality and security of online transactions.

4.8. Use of cookies and web beacons

From time to time when you visit an Amer Sports website, information may be placed on your computer to allow us to recognize your computer in the form of a text file known as a “cookie”. Our use of cookies is intended to provide benefits to you, such as eliminating the need for you to enter your password frequently during a session or the need to re-enter items you place in a shopping cart if you do not finish a transaction in a single visit. Cookies are also used for website traffic analysis and profiling. 

Some of the Amer Sports websites may also use other kinds of local storage technologies, such as Local Shared Objects (also referred to as “Flash cookies”) and HTML5 local storage. These technologies are similar to the cookies discussed above in that they are stored on your device and can be used to store certain information about your activities and preferences. However, these technologies may make use of different parts of your device from standard cookies, and so you might not be able to control them using standard browser tools and settings. Amer Sports may use so called web beacons (or “pixel tags”) in connection with some websites. However, we do not use them to identify individual users personally. Web beacons are typically graphic images that are placed on a website and they are used to count visitors to a website and/or to access certain cookies. This information is used to improve our services. Web beacons do not typically collect any other information than what your browser provides us with as a standard part of any internet communication. If you turn off cookies, the web beacon will no longer be able to track your specific activity. The web beacon may, however, continue to collect information of visits from your IP-address, but such information will no longer be personally identifiable.

However, we may not be able to provide certain services or you may not be able to view certain parts of this site if you have disabled cookies. 

Some of our business partners whose content is linked to or from our website may also use cookies or web beacons. However, we have no access to or control over these cookies.

You acknowledge and agree to the storage of cookies, other local storage technologies, beacons and other information on your devices and to the access of such cookies, local storage technologies, beacons and information by us and by the third parties mentioned above.

4.9. Your rights

You have the right to request information and access to the personal data we have collected from and of you. You also have the right to request that we replenish, rectify, anonymize or delete any incomplete, incorrect, unnecessary or outdated personal data we hold on you. However, we cannot delete such personal data that is necessary for compliance with binding legal obligations or if the personal data must be retained according to applicable laws. You have the right to request and receive the personal data we have collected on you in a commonly used and machine-readable form. In case you consider your personal data collected by us to be inaccurate, you do not wish your personal data to be deleted where the processing of your personal data has been deemed unlawful or the personal data is no longer necessary, or you have objected to the processing and the existence of legitimate grounds for processing is still under consideration, you may request restriction of processing of your personal data. 

You may also at any time object to your personal data being processed for direct marketing purposes, sending promotional materials, profiling, or for the performance of market research. Further, where your personal data is processed based on your consent, you have the right to withdraw your consent for such processing at any time.

In case you wish to make use of your rights mentioned above, you may, as appropriate and in accordance with applicable laws, exercise such rights by contacting us through the contact points referred in the marketing materials or below in this Policy. In some cases, especially if you wish us to delete or cease the processing of your personal data, this may also mean that we may not be able to continue to provide the services to you. We encourage you to use available profile management tools for the above purposes as such tools often provide you with direct access to your personal data and allow you to effectively manage it.

In the event you consider Amer Sports’ processing activities of your personal data to be inconsistent with the applicable data protection laws or that Amer Sports has not sufficiently ensured the realization of your rights, you may lodge a complaint with the local supervisory authority responsible for data protection matters.

4.12. Changes to this privacy policy

Amer Sports may from time to time update and change this Privacy Policy. If the changes include new purposes of processing, Amer Sports will give you prior notice of such changes and, where necessary, request your consent. 

5. Warning notice

Having regard to the nature of the internet, the user must bear in mind that generally, and despite the steps taken by Mavic, each time personal information is supplied online there is a
risk of it being collected illegally.
Accordingly, the user acknowledges that Mavic cannot be held responsible for the possible consequences in any circumstances.
Nevertheless, the pages of the Mavic sites on which payment details can be entered have enhanced security.
Mavic uses SSL encryption, and has also reinforced its rearrangement and encryption procedures to protect all sensitive data relating to means of payment as effectively as possible.
Prices on the website are suggested retail prices given for information purposes, therefore in order to know his retail price, the user has to contact his authorized Mavic retailer.

6. Applicable law

These General Conditions have been drafted and shall be construed in accordance with French law as in force. In the event that one or more provisions of these General Conditions is declared void or ineffective, the other clauses will remain in force to the fullest extent. In the event of a challenge, claim or dispute relating to these General Conditions, the parties will attempt to come to an agreed settlement. If the parties are not able to agree a settlement, the dispute will fall within the sole jurisdiction of the Annecy courts and the law applicable to these General Conditions will be French law.

7. Updating the General Conditions

Mavic reserves the right to amend or update the conditions of access to the sites as well as the General Conditions. Such amendments and updates apply to the user who, consequently, should refer to this section regularly in order to obtain the current General Conditions.

The Online Shop is owned by and operated by Mavic North America, a division of Amer Sports Winter & Outdoor Company (herein, "Mavic", "we" or "us" as the context may require). Amer Sports Winter & Outdoor Company is the seller of the Products. With regard to your purchases in the Online Shop we will communicate electronically by sending email or posting electronically. These Sales Terms only apply to purchases made in this Online Shop. Other Mavic web sites on the internet may have different terms and conditions. From time to time Mavic may change or alter these Sales Terms which will be applicable to orders placed on or after the effective date stated by Mavic. Information contained in Mavic's advertising, brochures or other written materials, on Mavic web sites or given to you, is for information only and not an offer by Mavic to supply any Products. 2. Placing an Order

3. Order Processing and Contract Formation

You agree that your order is an offer to buy the Products listed in your order under these Sales Terms. All orders must be accepted by Mavic. We may choose not to accept abnormal orders and orders which Mavic suspects are not placed in good faith. After having received your order, we will send you an acknowledgement email ("Your Mavic Order") with your order number and details of the items you have ordered. Acceptance of your order and the formation of the contract of sale between Mavic and you will not take place unless and until you have received your Mavic order confirmation email. You have the option to cancel your order at any stage by contacting Mavic customer service by calling 1.888.466.2842 before we have sent Your Mavic Order confirmation email.

4. Prices, Shipping and Handling, Charges and Taxes

The price charged for a Product will be the price in effect at the time the order is placed and will be set out in the order receipt and order confirmation emails. Mavic may change prices at any time without notice. Price increases will only apply to orders placed after such changes. Mavic charges sales tax where required by law. If you are shipping to states where sales tax is charged, the appropriate charges will be added to your merchandise total and displayed in your Mavic Order. Prices for the Products do not include charges for shipping and handling. Separate charges for tax and shipping will be itemized in your shopping cart and on Your Mavic order confirmation email.

5. Product Availability and Delivery, Circumstances Beyond Reasonable Control

Mavic does not guarantee the availability of any Product in the Online Shop. Mavic reserves the right, without liability or earlier notice, to change, discontinue or stop making any Product. We will provide you with the information on the latest expected delivery date which will not exceed 30 days unless you specifically agree on a later date. In case you unreasonably defer delivery or delay the receipt of delivery after we have notified you that we have tried to deliver the ordered items to you, or if you have provided us with an incorrect delivery address which results in an unsuccessful delivery, the delivery package will be returned to us. Delivery options are defined in checkout and may change. Delivery based on the option selected is not guaranteed. Reimbursement for payment of the express delivery price will occur if the service requested was not delivered on time. If the items remain undelivered and are returned to us undelivered, we consider that you have exercised your right to cancel the contract and when we receive the returned delivery package we will refund you in accordance with our return policy less the reasonable additional costs incurred by Mavic. Customer desiring to return or refuse delivery will be best serviced by receiving the delivery and following the return instructions included in the package. Mavic shall not be held responsible for delay or failure to perform if the delay or failure is caused by any circumstances beyond its reasonable control including but not limited to acts of war or terror, strikes, national or local states of emergency, inclement weather, failure of transportation facilities, power or utility outages, earthquakes, or other natural disasters.

6. Compatibility, Product Information

When placing your order please ensure that the Products you purchased are compatible for the intended use. Please use the information provided in the Online Shop as reference when checking compatibility. In the event of a difference between the Online Shop content and any other Mavic (or non- Mavic) web site (or any other source of information) the compatibility of Products as shown on the Online Shop at the time of purchase will be seen as taking precedence. We encourage you to examine the delivery package and received items within fourteen days after they are delivered to you and check their condition and that the content of the delivery package is complete.

7. Payment

Payment by credit/debit cards shall be made by a credit or debit card approved by Mavic. Approved credit and debit card types are listed in the Online Shop. You have to supply your payment card details when you place your order. Your credit card may not be accepted if: (i) the name on the credit card does not match the billing name given or (ii) the billing address given does not match the bank records. Your payment card will be charged on shipment of the ordered items. We will not supply the items to you until your card issuer has authorized the use of your card for payment of the ordered Products. As your Order confirmation email is your proof of purchase, we recommend that you save and print that document for your potential future use.

8. Title to Products
